Welcome to Ziggyloo. By accessing or using the Ziggyloo website (www.ziggyloo.com), mobile application, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.
1. About Ziggyloo
Ziggyloo, LLC (“Ziggyloo,” “we,” “us,” or “our”) provides an AI-powered adaptive learning companion designed for children ages 3-10, with a particular focus on neurodiverse learners. The Service is intended to be used by parents or legal guardians (“Parents”) on behalf of their children.
The Service uses artificial intelligence technology, including third-party AI models, to generate educational content, stories, and interactive conversations. AI-generated content may occasionally contain errors or inaccuracies. The Service does not constitute professional educational, medical, therapeutic, or diagnostic advice.
2. Account terms and eligibility
You must be at least 18 years old and a parent or legal guardian to create an account. By creating an account, you represent and warrant that you meet these eligibility requirements. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.
We verify parental status through our email verification process and payment card authorization. These methods serve as our age verification mechanism in compliance with COPPA requirements.
3. Children's privacy and COPPA compliance
Ziggyloo is designed to comply with the Children's Online Privacy Protection Act (COPPA) and all applicable children's privacy regulations. Key commitments:
- Only Parents may create accounts. Children cannot create accounts independently.
- We require verifiable parental consent before collecting any information from children under 13, using email verification and payment authorization as consent mechanisms.
- Your data is not our product; your subscription is.
- We do not sell, rent, or trade any personal information — parent or child — to third parties for any purpose.
- We do not serve advertisements of any kind to children or within the child-facing areas of the Service.

4. Subscription and billing
Ziggyloo offers the following subscription plans:
- Ziggyloo — $19.95 per month for one (1) child profile, including all features and learning domains.
- Ziggyloo Family — $29.95 per month for up to four (4) child profiles, including all features and learning domains with individual progress tracking for each child.
New subscribers receive a 30-day free trial. A valid payment method is required to begin the trial. Your payment method will not be charged until the trial period ends. If you cancel before the trial period expires, you will not be charged.
- Automatic renewal: Your subscription automatically renews each month on the same date unless you cancel before the next billing date. You authorize us to charge your payment method on file for each renewal period.
- Cancellation: You may cancel your subscription at any time through your parent dashboard or by contacting support@ziggyloo.com. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until that date.
- Refunds: We do not provide refunds for partial billing periods. If you cancel mid-cycle, you retain full access until the end of your paid period.
- Price changes: We may adjust subscription pricing with at least thirty (30) days' written notice via email. Price changes apply to the next billing cycle after the notice period. If you do not agree with a price change, you may cancel your subscription before the new price takes effect.
5. Acceptable use
You agree to use the Service only for its intended educational purpose and in compliance with all applicable laws. You may not:
- Attempt to reverse engineer, decompile, disassemble, or extract the source code of Ziggyloo's software or AI systems.
- Use the Service to collect, harvest, or store data about other users.
- Share your account credentials with anyone outside your household.
- Use automated scripts, bots, or similar tools to access the Service.
- Transmit any harmful, offensive, or illegal content through the Service.
- Use the Service in any way that violates applicable local, state, national, or international laws or regulations.
6. Account suspension and termination
We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe that:
- You have violated these Terms or any applicable law.
- Your use of the Service poses a risk to other users, to us, or to third parties.
- Your account has been inactive for an extended period.
Upon termination, your right to access the Service ceases immediately. You may request a copy of your data prior to account deletion in accordance with our Privacy Policy. Any fees already paid are non-refundable upon termination for cause.
7. Intellectual property
All content, characters, stories, artwork, software, and technology within the Ziggyloo Service are the exclusive property of Ziggyloo, LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. This includes, without limitation, the 42 Ziggyloo characters, 11 biome worlds, and all related creative works.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any Ziggyloo content without our prior written permission.
Content created by your child within the Service (such as artwork and stories) remains your family's property. By using the Service, you grant Ziggyloo a non-exclusive, royalty-free license to use anonymized, aggregated data derived from Service usage to improve our educational models and Service quality. No individually identifiable information is used for this purpose.
8. AI-generated content disclaimer
The Service uses artificial intelligence, including third-party AI models provided by OpenAI and other technology partners, to generate educational content and interactive experiences. You acknowledge and agree that:
- AI-generated content may occasionally contain inaccuracies, errors, or unexpected responses.
- The Service is an educational supplement and does not replace professional educational services, special education programs, therapy, medical advice, or clinical diagnosis.
- Our AI does not diagnose medical or developmental conditions, and its assessments of learning progress are informational only.
- We continuously monitor and improve our AI systems but cannot guarantee error-free operation.
9. Data processing and AI training
To provide and improve the Service, interaction data is processed through our AI systems. Our third-party AI provider (OpenAI) processes conversation data under a data processing agreement that prohibits retention of user data for their own model training. Ziggyloo may use anonymized, aggregated usage patterns to improve its educational models. No individually identifiable child data is used for AI model training purposes.
10. Service availability
We strive to maintain continuous availability of the Service but do not guarantee uninterrupted or error-free access. We may temporarily suspend the Service for maintenance, updates, security patches, or circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, government actions, internet or telecommunications outages, failures of third-party service providers, cyberattacks, or other force majeure events. We will provide reasonable advance notice of planned maintenance when possible.
11. Limitation of liability
To the maximum extent permitted by applicable law:
- Ziggyloo's total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the total amount you paid to Ziggyloo in the twelve (12) months immediately preceding the event giving rise to the claim.
- In no event shall Ziggyloo, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, regardless of whether we have been advised of the possibility of such damages.
- We are not responsible for educational outcomes, developmental progress, or any decisions made based on information provided by the Service.
12. Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade. We do not warrant that the Service will meet your specific requirements or expectations regarding educational outcomes.
13. Indemnification
You agree to indemnify, defend, and hold harmless Ziggyloo, LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any content or data you submit through the Service.
14. Dispute resolution
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith informal negotiation. If the dispute cannot be resolved informally within thirty (30) days, either party may initiate binding arbitration under the rules of the American Arbitration Association (“AAA”) in Gwinnett County, Georgia.
Class action waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Ziggyloo.
Small claims exception: Either party may bring an individual action in small claims court in Gwinnett County, Georgia, if the claim falls within the court's jurisdictional limits.
15. Governing law
These Terms are governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law principles. To the extent that arbitration is not applicable, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Gwinnett County, Georgia.
16. Changes to these terms
We may update these Terms from time to time. For material changes — including changes to billing, data practices, or arbitration provisions — we will notify you by email at least thirty (30) days before they take effect and may require your affirmative consent before the changes apply to your account. For non-material changes, your continued use of the Service after the updated Terms are posted constitutes acceptance.
17. General provisions
- Severability: If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
- Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Ziggyloo regarding your use of the Service and supersede all prior agreements, understandings, and communications.
- Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
- Assignment: You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.
